GRAND JURY INDICTS MAN FOR GRABBING CHILD BY HAIR, FLINGING HIM INTO WALL

A Baytown man accused of continuously assaulting a female family member, presumably his wife — including punching her between the shoulder blades — and grabbing her child by the hair and tossing him into a wall, has been indicted on one count of continous violence against a family member and injury to a child.

Joseph Allen Edwards of Baytown, faces up to 10 years in prison and a $10,000 fine for each count if convictedof the third degree felony offenses.An indictment is not an indication of guilt.

It is a formal accusation of a felony, issued by a grand jury based upon a proposed charge, witnesses’ testimony and other evidence presented by the public prosecutor (District Attorney).

It is the grand jury’s determination that there is enough evidence that the defendant committed the crime to justify having a trial voted by a grand jury. In order to issue an indictment, the grand jury doesn’t make a determination of guilt, but only the probability that a crime was committed, that the accused person did it and that he/she should be tried.

District Attorneys do not present a full case to the grand jury, but often only introduce key facts sufficient to show the probability that the accused committed a crime.  

Chambers County grand jurors indicted: n Elton Laroy Young of New Caney, Texas, on one count of forgery, a state jail felony offense. He is accused of forging someone else’s name on a $50 reserve note and cashing it on Aug. 23, 2010.n Wesley Ray Kersh of Highlands, Texas, on one count of forgery, a state jail felony offense. He is accused of forging someone else’s name on a $50 reserve note and cashing it on Aug. 23, 2010.n Corisa Tyyette Cratic of Houston, on one count of possessing between five pounds and 50 pounds of marijuana on Aug. 4, 2010, a third degree felony offense. Bond was set at $15,000.n Eric Tremaine McCoy of Houston, on one count of possessing between five pounds and 50 pounds of marijuana on Aug. 4, 2010, a third degree felony offense. Bond was set at $15,000.n Levar Lee of LaPorte, on one count of possessing a controlled substance, between one gram and four grams of benzylpiperazine, a third degree felony offense. Benzylpiperazine (BZP) is a recreational drug with euphoric, stimulant properties. The effects produced by BZP are comparable to those produced by amphetamine. Adverse effects have been reported following its use including acute psychosis, renal toxicity, and seizures. Bond was set at $15,000.n Charles Edward Franklin of Houston, on one count of possessing marijuana on June 18, 2010, four ounces to five pounds, a state jail felony offense. Bond was set at $15,000.n Darren Paul Frye of Plaquemine Parish, La., on one count of possessing marijuana on June 11, 2010, five pounds to 50 pounds, a third degree felony offense. Bond was set at $30,000.n Latasha Marie Phillips of Calhoun City, Ms., on one count of possessing marijuana on Aug. 5, 2010, five pounds to 50 pounds, a third degree felony offense. Bond was set at $15,000.n Jordan Patrick Simon of Lafayette, La., on one count of possessing with intent to deliver a controlled substance on July 2, 2010, between 200 grams and 400 grams of hyrdrocodienone, a second degree felony offense. Menard of Opelousas, La., on  one count of possessing with intent to deliver a controlled substance on July 2, 2010, between 200 grams and 400 grams of hyrdrocodienone, a second degree felony offense. Bond was set at $15,000.n Tonya Marie Trahan of Warren, Texas, on one count of unauthorized use of a motor vehicle. Bond was set at $10,000.n Santi Phommavongsa of Houston, on one count of possessing marijuana on Aug. 6, 2010, five pounds to 50 pounds, a third degree felony offense. Bond was set at $15,000.n Christopher Villarreal III of McAllen, Texas, on one count of possessing marijuana on May 28, 2010, five pounds to 50 pounds, a third degree felony offense. Bond was set at $25,000.n Roger Allen Cormier of Orange, Texas, on one count of felony driving while intoxicated on May 28, 2010, a third degree felony offense. According to court records, Cormier was convicted of DWI in Orange County in October 1993 and convicted of driving under the influence in Jefferson County in May 1996. Bond was set at $10,000.n Frank Lamarcus Rogers of Baytown, on two counts of aggravated robbery, a first degree felony offense. He is accused of threatening two women on Nov. 29, 2010. Prosecutors say Rogers displayed a firearm during the alleged criminal act. She is accused of attempting to swallow prescription medication to prevent it from being used as evidence against her, a state jail felony offense. The pills were prescribed for another person, according to court documents. Bond was set at $10,000.n Jaime Fortuna Garcia, on one count of possessing marijuana on Nov. 19, 2010, 50 pounds to 2,000 pounds, a second degree felony offense. Bond was set at $15,000.n James Earl Joseph of Houston, on one count of evading arrest with a vehicle, a state jail felony offense. He is accused of attempting to flee from a peace officer on Aug. 31, 2009. The charge may be enhanced to a third degree felony offense because Joseph has already been convicted in Harris County of evading arrest, accoring to the indictment. Bond was set at $15,000.n Cary James Lewis of San Diego, Calif., on one count of possessing a controlled substance on Aug. 28, 2010, between 28 grams and 200 grams of codeine, a third degree felony offense. Bond was set at $20,000.
